Ask HPD: Loitering on School Grounds

Question: Are people allowed to be on school campuses during non-school hours?

Answer: Under state law, no one is allowed to be on public or private school grounds without lawful business or excuse for doing so. This is considered criminal trespassing in the first degree, which is a misdemeanor (HRS 708-813).

Question: Does this include the school playground?

Answer: This includes any playgrounds on school campuses. Violators can face up to one year in jail and/or a fine of up to $2,000 (HRS 706-663 and HRS 706-640).
